Acceptance of Terms

By accessing and using this portfolio website ("the Site"), owned and operated by Starford Mogaka Omwocha ("I," "me," "my," "the owner"), you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you should discontinue use of the Site immediately.

These terms apply to all visitors, users, and anyone who accesses or submits information through the Site. Continued use after any posted modifications constitutes acceptance of the updated terms.

Site Purpose & Scope

This Site serves as a professional developer portfolio showcasing:

• Technical skills, project showcases, and professional experience.
• A contact mechanism for potential collaborators, clients, and recruiters.
• An admin dashboard, restricted exclusively to the Site owner.

The Site does not offer commercial services, process payments, handle user accounts for visitors, or provide downloadable software. It is an informational and contact-only platform.

User Conduct & Responsibilities

When using the contact form or interacting with the Site, you agree to:

• Provide accurate information. Submitting intentionally falsified identity details, impersonating others, or using automated spam bots violates these terms.
• Refrain from abuse. Harassing, threatening, or submitting abusive content through the contact form is prohibited. Such messages will be discarded without response, and the sending IP may be blocked from further submissions.
• No scraping or unauthorized access. Automated data extraction, credential brute-forcing against the admin dashboard, or probing internal API structures for unintended access is strictly forbidden.
• Respect the admin boundary. The admin dashboard is a private operational panel. Attempting to access it without authorization is a breach of these terms and applicable computer misuse laws.

Intellectual Property

All rights reserved. The visual design, layout, custom CSS animations, color theme configuration, HTML structure, JavaScript interaction logic, typographic selections, and overall presentation of this Site are original intellectual works of Starford Mogaka Omwocha.

The project screenshots and descriptions displayed in the Projects section represent my own development work. Reproduction, cloning, redistribution of the Site's design, codebase, or visual assets without explicit written permission is prohibited. Inspiration drawn from publicly viewable portfolio design patterns is welcomed through attribution; direct copying without attribution is not.

Disclaimer of Warranties

"As-Is" basis. This Site is provided on an "as-is" and "as-available" basis without warranties of any kind, express or implied. This includes, without limitation:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Guarantees of uninterrupted, timely, secure, or error-free operation.
• Accuracy or reliability of any project descriptions, personal statements, or skill estimates displayed. These are self-assessments and should be evaluated independently.

The Site is a personal developer portfolio and does not constitute a contractual offer of services. Contacting through the form initiates a conversation, not a binding engagement.

Limitation of Liability

To the fullest extent permitted by applicable law, Starford Mogaka Omwocha shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, goodwill, or other intangible losses — resulting from:

• Your use or inability to use the Site.
• Unauthorized access to or alteration of your submitted contact data (covered separately by the Privacy Policy's security commitments).
• Statements, representations, or conduct of any third party on the Site (the Site has no third-party content beyond CDN-hosted fonts, icons, and stylesheets).

This limitation applies regardless of the legal theory under which damages are sought — contract, tort (including negligence), strict liability, or otherwise — and even if the owner has been advised of the possibility of such damages.

Because some jurisdictions do not allow limitations on implied warranties or the exclusion of certain damages, some of the above disclaimers may not apply to you. In such cases, liability is limited to the fullest extent permitted by governing law.

Third-Party Resources

This Site loads resources from the following third-party CDNs, which are publicly hosted open-source libraries. Their inclusion does not constitute endorsement, and this portfolio is not responsible for the content or availability of these CDN endpoints:

• Tailwind CSS — loaded via cdn.tailwindcss.com. A utility-first CSS framework used for styling the Site. Tailwind does not set cookies or collect data through its CDN.
• Google Fonts — served from fonts.googleapis.com. Delivers Plus Jakarta Sans and JetBrains Mono font files. Google Fonts API requests may log IP addresses for rate-limiting but do not associate those logs with Google accounts or user profiles.
• Font Awesome 6.4.0 — loaded via cdnjs.cloudflare.com. An open-source icon library used for all iconography throughout the Site.

Governing Law & Jurisdiction

These Terms of Use and any disputes arising from or relating to them shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to conflict-of-law principles.

Any legal action or proceeding relating to the Site or these terms shall be brought exclusively in the competent courts of Nairobi, Kenya. By using the Site, you consent to personal jurisdiction in these courts for any such dispute. This choice of venue does not deprive you of mandatory consumer protections applicable in your country of residence where such protections cannot be waived by contract.
